Timeframe for NDIS Internal Reviews Determined
A new decision by the Administrative Appeals Tribunal (AAT) has found that there is a timeframe in which that the National Disability Insurance Agency must complete internal reviews.
If the NDIA does not complete an internal review within this timeframe, persons directly affected can proceed directly to the AAT for independent review.
For some time now our NDIS Appeals Team has been advocating for reasonable timeframes for the National Disability Insurance Agency to make decisions regarding Internal Reviews. The impact on individuals and families has been significant; causing further anxiety, stress and confusion for families as to how to budget funding while an internal review is occurring. Additionally, participants may be missing out on crucial supports for extended periods of time. This is of particular concern for the early childhood early intervention cohort.
This result from the AAT has implications for people across the country waiting for the outcome of Internal Reviews.
